well.....after reviewing the bid, contacting 6 references, checking the BBB and online, looks like I goofed.
Our foundation contract said $15K down, balance on completion, he poured the footers then with out any other notice sent me a invoice for another $15K
When I called him I was informed that he put many bids out and it must have just forgot to add the line for another $15K after the footers were done (he sounded a little shocked that I would not just cut him another check).
He then informed me that I could pay for the upcoming concrete and more fill and just give him a check for $5K.....??????
I had a picture of the truck that delivered and called Austin Ready Mix several days later and was informed that the check was written incorrectly and could I come in and pay the amount owed?...NO, that is up to Larry to pay or you can turn over to the DA for hot check as far as I was concerned.(yes I know, lien on property issues)
The good news is that he did drop off about $9K worth of re-bar for the foundation on the property so we are able to use this to continue the construction.
